3. Eligibility

Our services may be used by individuals and businesses worldwide.

To use our services, you must:

• Be legally capable under Queensland law

• Use the services for lawful purposes only

• Be at least 16 years of age

We may refuse service to any business or individual at our discretion, including based on industry type or risk profile.

4. Payment Terms

a. Payment Models

We offer:

• Monthly retainers

• Subscription fees

• One-off project fees

• Free trial periods (1 month)

b. Free Trial

Your free trial lasts one month from the day your service is created.
During the trial period, you may cancel at any time with no charge.

c. Billing Cycle

Billing occurs monthly, on the same date the automation/service was implemented.

Payments are due immediately on each billing date.

d. Refunds

Other than the free trial period, all payments are non-refundable.
This includes:

• Monthly subscription payments

• Setup fees

• Automation builds

• One-off fees

Missed or failed payments may result in service suspension.

5. User Responsibilities

You agree to:

• Use our services only for lawful purposes

• Comply with all applicable laws (including Queensland/Australian spam and privacy laws)

• Provide accurate and truthful information

• Maintain the confidentiality of your login credentials

• Not misuse automations or AI tools

• Not upload illegal, harmful, or offensive content

• Not manipulate, disrupt, or interfere with our systems

• Not reverse-engineer or copy proprietary workflows

You are responsible for verifying the accuracy of AI-generated output before using it in your business.

6. Company Rights

BrainBulb Automation reserves the right to:

• Modify services or pricing

• Suspend or terminate a user for policy violations

• Refuse service at our discretion

• Remove harmful or illegal content

• Pause services for system maintenance

• Enforce usage limits to protect system integrity

• Protect our intellectual property and proprietary workflows

We may also terminate a user immediately if we believe actions threaten our service quality, security, or legal compliance.

7. Intellectual Property

a. Ownership

BrainBulb Automation owns:

• Proprietary automation workflows

• System designs

• Templates

• Dashboards and interfaces

• Branding and marketing assets

b. Client Ownership

Clients own:

• Their personal data

• Their business data integrated into our tools

• AI-generated outputs we produce for them

You receive a license to use our automations but not ownership of the underlying proprietary systems unless expressly stated in writing.

8. AI Use, Limitations & Accuracy

Our services involve third-party AI providers such as OpenAI, Grok, Make, Twilio, and GoHighLevel.

AI can:

• Generate inaccurate or incomplete information

• Produce unexpected content

• Make suggestions that must be validated manually

You acknowledge:

• AI outputs may contain errors

• You are responsible for verifying all outputs before relying on them

• We do not guarantee accuracy, completeness, or suitability for specific purposes

BrainBulb Automation is not responsible for:

• Business losses caused by reliance on AI output

• Financial loss, reputational harm, or missed opportunities

• Incorrect, offensive, or unintended AI-generated content

9. Limitation of Liability

To the fullest extent permitted by law:

• BrainBulb Automation is not liable for indirect, incidental, or consequential damages

• We are not liable for business losses, revenue loss, or data loss

• We are not liable for AI mistakes, automation errors, or system downtime

• We do not warrant uninterrupted, timely, or error-free services

• All services are provided “as is” without warranties

If liability cannot be excluded, our total liability will not exceed the amount paid by you in the previous 30 days.

10. Dispute Resolution

Disputes will be handled as follows:

1. Initial good-faith negotiation

2. Mediation in Queensland, Australia

3. Direct legal action if warranted

You agree to Queensland jurisdiction for any legal proceedings.

11. Termination

We may terminate or suspend services if:

• Payments are overdue

• You violate these Terms

• You misuse the service

• You cause security or operational risks

• You use the service unlawfully

You may terminate your subscription at any time, but no refunds are provided (other than during the free trial).

12. Service Restrictions

There are no industry restrictions, but BrainBulb Automation reserves the right to decline service to any business at our discretion for safety, risk, ethical, or operational reasons.
